These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions, you may not use or access this Website.

Use of the website

Registration

You warrant that:

  • The Personal Information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects; and

  • You will notify us immediately of any changes to the Personal Information by contacting us by e-mail

You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.

We reserve the right to:

  • modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or

  • change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

Third party links

To provide increased value to our Users, we may provide links to other websites or resources for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for (i) the privacy practices of such websites, (ii) the content of such websites, including (without limitation) any advertising, content, products, products or other materials or services on or available from such websites or resources or (iii) the use to which others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, products or other materials or services available on such external websites or resources.

Privacy

We will treat all your Personal Information as confidential (although we reserve the right to disclose this information in the circumstances set out below). 

  • When you shop on this Website, we will ask you to input and will collect Personal Information from you such as your name, e-mail address, billing address, delivery address, telephone number, product selections, credit card or other payment information and a password. 

  • We may also collect, and our third party providers of advertisements and content may collect, information about where you are on the internet (eg the URL you came from, IP address, domain types like .co.uk and .com), your browser type, the country and telephone area code where your computer is located, the pages of our website that were viewed during your visit, the advertisements you clicked on, and any search terms that you entered on our website (“User Information”). 

  • We may collect this information even if you do not register with us.

  • You should be aware that this site is being monitored and may capture information about your visit that will help us improve the quality of our service, or be used to present you with Moderne products which are relevant to your browsing history when you visit other websites. 

We confirm that any Personal Information which you provide to us (or which is available on public registers) and any User Information from which we can identify you, is held in accordance with the registration we have with the Data Commissioner’s Office. We use your information only for the following purposes of processing your orders.

Products 

  • We endeavour to describe all items as fully as possible, to the best of our knowledge, providing as much history, age and detail as is known to us together with a full description of any discernable defects or faults. 

  • Items are antique or vintage items, which may in some cases, have some age-related wear. Items that are manufactured some time ago often have marks, dents, variations of surface texture, re-polished surfaces, minor scratches or losses, sympathetic replacements, retouching, relining, and other issues naturally associated with use and age which form a part of the appearance and nature of a vintage item

  • We aim to ensure that the condition of any item is as reasonable as possible given its age and nature, and would not offer for sale any item that is not substantially complete or in a minimum acceptable condition for display or use

  • Substantial damage or extensive restoration or changes or losses to the item beyond this will be stated in our item descriptions

  • Small signs of wear are normal and appropriate to the authenticity of vintage products. By placing an order, you are deemed to acknowledge the vintage nature of the products we are selling

  • We will take all reasonable steps to pack the products properly and to ensure that you receive your order in good condition

  • We shall not be liable for any defect in the products arising from wear and tear, willful damage, accident and/or negligence by you or any third party, if you use the products in a way that we or the manufacturers do not recommend, you fail to follow the manufacturer’s and/or our instructions, or due to any alteration or repair you carry out without our prior written approval.

  • The products we sell are authentic, original products, which were manufactured before today’s stringent health and safety standards. All sales of such products are for collection purposes only. We do not guarantee or imply any guarantee of compliance with health and safety standards or fitness for any purpose. All original vintage products are clearly marked as such in the product description with a date or approximate date of manufacture

  • We will not be liable for any loss, injury or death caused by electrical products that have not been inspected, tested and certified by a qualified electrician prior to installation in your premises. 

Deliveries

Small Items 

  • For small items capable of being shipped by courier, unless otherwise stated, we will aim to ship your order within 4 to 6 working days of it being placed

  • All smaller items sent by us via courier companies will be fully insured against loss or damage. This cost is included in the shipping cost

  • Items picked up by your own delivery companies or sent by third party delivery services are not covered by us. They should all have their own insurance we recommend you check and confirm insurance cover with them

Large Items 

For large Items there are 3 options available. 

Third party delivery providers 

  • We can provide details of third party priovders for the delivery of your purchased products. We are happy to contact them on your behalf to provide them with your contact details

  • We will communicate with your choice of provider to arrange pick up times

  • Payments will need to be made directly with third party couriers or shippers and you will need to communicate directly with them, once the products have left our premises.

  • For the avoidance of doubt, contracts are between you and the third party company and as such The Collectables take no responsibility once the item has left our premises. We will however, always help where we can. 

Customer’s own arrangement

  • You are also more than welcome to arrange a courier yourself or to collect the product from us in person but we do not accept any liabilty for damage which may happen once your item has left our care. Please let us know your arrangements as soon as possible for speedy delivery. 

The Collectables delivery service 

  •        The Collectables offer a premium service, hand delivered by us so we guarantee the safe delivery of your product…… 

Please contact us prior to purchase for a personal quote, if you chose to accept we will do our best to deliver at a time which is convenient to you but we may not always be able to offer this.

Ordering and cancellations 

Orders

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website. See our Refund policy below which is incorporated into these Conditions.

The steps required to create the contract between you and us are as follows:

  • You place the order for your products on the Website by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website

  • We will send you an order acknowledgement email detailing the products you have ordered. 

  • Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the Products ordered unless we have notified you that we do not accept your order, or you have cancelled it in accordance with the instructions in Change or cancel an order

  • You will be charged and payment taken immediately upon purchasing through the website.

Non-acceptance of an order may be a result of one of the following:

  • The product you ordered being unavailable from stock

  • Our inability to obtain authorisation for your payment

  • The identification of a pricing or product description error

  • Your not meeting the eligibility to order criteria set out in the main Terms & Conditions

Cancellations 

We’re sorry it’s not possible to make changes to your order once you’ve placed it.

  • To add products to your order, please place a new order for these items

  • To change details of your delivery address, remove items from your order or cancel it completely, please contact us by email. Please be ready to quote your order number and order date

  • If your order has already been despatched or delivered, then you’ll need to follow our Returns procedure in the event of any unwanted products, or return them to us

  • If you’re an international customer please contact us  

Refund & Returns Policy 

We want you to be happy with your purchase but we can only refund if goods are not fit for purpose, are faulty or have been grossly misdescribed at the point of sale. We inspect all our products thoroughly but all goods are sold as seen and do not come with any guarantee due to their second-hand nature. We do not accept any liability for damage to goods once you have purchased and collected or we have delivered, it is your responsibility to check your purchase for collection or delivery and raise any concerns or issues at such a time. 

Under Consumer Contracts Regulations 2013, if you buy online or by phone, your consumer rights entitle you to a full refund if you request one in writing within 14 working days of receipt.

Consumer Contracts Regulations 2013

This legislation offers you the following cancellation rights when you buy online or by phone. 

  • You are entitled to cancel your contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the products or services.

  • Your right to return products does not apply to products made to your specification, that have been clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.

  • If you wish to exercise your right of cancellation, you are obliged to retain possession of the products and take reasonable care of them.

  • To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order you wish to cancel and, where available, your phone number and email address.

  • If you decide to cancel, you should return the products to us at your cost within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to products to which cancellation rights apply. This excludes the cost of delivery.

  • We will make a deduction from the reimbursement for loss in value or damage of any products supplied to you if the loss is the result of unnecessary handling by you and or third party couriers provided by you. We will also deduct the cost of any repairs/replacements/restoration or alterations you have requested prior to purchase. We will make the reimbursement no later than 14 days after the day we receive back from you any products supplied.

In the unlikely event that the products delivered do not conform to these terms and the order, you must inform us within 24 hours after receipt. 

  • Freight items delivered via third party delivery services must be checked thoroughly and approved by you when you take receipt of them and any problems notified to the driver at the time of delivery. You must then seek to resolve this via the insurance of said third party delivery service.

  • Subject as set out herein, we may ask you to return the products to us and once we have checked that the products are faulty, we may:

    • provide you with a full or partial refund (including shipping costs); or

    • repair the products.
